Musashi $5000 Fuel Voucher Promotion

  FULL TERMS AND CONDITIONS
  1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion (“Promotion") is deemed acceptance of these terms and conditions.
  2. The promotion is only open to New Zealand residents aged 18 years or over, who are registered members of the Flybuys or Airpoints™ programme. Employees of Vitaco Health NZ (New Zealand) Limited (the “Promoter”), and Z Energy Limited and their immediate families, as well as the owners, managers, and staff of each Participating Store and their immediate families, are ineligible to enter. Employees of Loyalty New Zealand (which runs the Flybuys programme) or Air New Zealand (which runs the AirpointsTM programme), and their immediate families, are also ineligible to enter.
  3. The Promotion is limited to participating Z Energy retail stores that have been invited by the Promoter to participate and which display material advertising this Promotion (“Participating Stores”).
  4. Entries into the Promotion open at 12.01am on Monday 8th of May 2023 and close at 11.59pm on Monday 5th June 2023 (the “Promotional Period”). Entries received outside the Promotional Period will not be entered into the prize draw.
  5. To enter, individuals must purchase any 2 Musashi Energy 500ml cans in a single transaction (“Participating Products”) from a Participating Store during the Promotional Period and swipe their registered Flybuys card or Airpoints™ card at the time of purchase of the Qualifying Products at the checkout (“Qualifying Transaction”). Limit of one (1) entry per two (2) Participating Products purchased. Multiple entries are permitted, provided that each entry is through a separate Qualifying Transaction and is in accordance with the entry requirements stated in this clause.
  6. There are a total of five (5) Prizes available to be won. Each Prize consists of a $1,000 Z gift card (RRP $1,000) (“Prize”). These gift cards expire 24 months from the date of purchase. There is a limit of one (1) Prize per person.
  7. Prizes are not transferable, changeable, or redeemable for cash.
  8. If the Prize or any part of a Prize becomes unavailable for any reason beyond the Promoter’s control, the Promoter may in its sole discretion decide to provide an alternative prize.
  9. The Prize winners will be determined by way of random draw by the Head Office of Z Energy Ltd at 3 Queens Wharf, Wellington 6011 from all valid entries received by the Promoter during the Promotional Period on 16th June 2023. The Prize winners will be the first five (5) valid entries randomly drawn by Z Energy Ltd. The draw conductor may draw additional reserve entries to be used in the case of an invalid entry or entrant being drawn.
  10. Prize winners will be contacted by phone by the Promoter or Z Energy Limited on the phone number listed on the winning Flybuys or Airpoints™ account. The winner will be deemed to be the person listed as the primary cardholder on the winning Flybuys or Airpoints™ account (regardless of who made the Qualifying Transaction). Neither the Promoter, Z Energy Limited, Loyalty New Zealand Limited nor Air New Zealand Limited will be responsible in any way for any disputes arising as a result of entries being submitted by persons other than the primary cardholder. Entrants are responsible for ensuring the contact details associated with their Flybuys or Airpoints™ account are correct at the time of entry.
  11. Prize winners must provide the Promoter and/or Z Energy Limited with a valid New Zealand residential delivery address within seven (7) days of being contacted. If a valid New Zealand residential delivery address is not received within that period, the winner’s Prize will be void and no compensation will be payable.
  12. Prizes will be delivered to the address nominated by the winner within 31 days of the winner providing the Promoter or Z Energy Limited with a valid New Zealand residential delivery address.
  13. If (a) an ineligible entry is drawn (for example if the entrant is not a New Zealand resident or is not over 18 years or over), or (b) a winner has already been selected to win another Prize, or (c) the Promoter or Z Energy Limited is unable to contact a winner within seven (7) days of the Prize draw, having made reasonable attempts to do so, the Promoter may deem that winner’s entry invalid and select a new winner on the same terms as the original Prize draw.
  14. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
  15. Neither the Promoter nor any other agency associated with this Promotion will be responsible for any late, lost, misdirected or incorrectly submitted entries, including but not limited to entries not received due to technical problems or human error. Entries are deemed received at the time they are received by the Promoter, and not at the time of transmission by the entrant.
  16. The Promoter reserves the right to verify the validity of a Prize winner’s entry and disqualify any entry or refuse to award a Prize where false or misleading details have been given by an entrant or an entrant has behaved in a fraudulent, dishonest, or disruptive manner, or otherwise than in accordance with these terms and conditions or the spirit of the Promotion. The Promoter reserves the right to disallow entries in its absolute discretion and without giving reasons.
  17. The Prize winners acknowledge and agree that they will comply with all instructions given by employees and agents of the Promoter and other agencies associated with this Promotion and agree not to do anything that may bring the Promoter or such agencies into disrepute.
  18. Except for any liability that cannot be excluded by law, the Promoter and Z Energy Limited exclude all liability (including negligence), for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where attributable to any of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s and/or Z Energy Limited’s control); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected; (d) any variation in the Prize; (e) any tax liability incurred by a claimant or entrant; or (f) use of a Prize.
  19. The Promoter and Z Energy Limited may receive and hold personal information of entrants for the purposes of the Promotion. All personal information provided by entrants will be held by the Promoter and Z Energy Limited in accordance with the Privacy Act 2020. The Prize winners authorise Loyalty New Zealand Limited (which runs the Flybuys Programme) and/or Air New Zealand (which runs the Airpoints™ programme) to provide their contact details to the Promoter and/or Z Energy Limited and their agents and further for these parties to use this information for the purposes of the Promotion, including for notifying Prize winners and facilitating redemption of the Prize. Failure to provide requested personal information may disqualify a person from entering the Promotion or being able to receive a Prize.  
  20. The Promoter’s decision is final on all matters and no correspondence will be entered into.
  21. The Promoter and Z Energy Limited reserve the right to alter, amend, or supplement these Terms and Conditions from time to time in their absolute discretion.
  22. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

  24. These Terms and Conditions are governed by New Zealand law and any dispute arising out of or in connection with them will be subject to the exclusive jurisdiction of the New Zealand courts.
