Interpretation
1. In these Z Crew Offer Terms and Conditions (Terms), unless the context requires
otherwise:
the words “Z”, “we”, “our” and “us” means Z Energy Limited and the words “you” and
“your” means the applicable company or person(s) with whom we have agreed to
provide access to the Z Crew Offer (Z Business Customer).
Employee means any person employed by you on a permanent full time or part time
basis.
Fuel means regular 91 and premium 95 petrol and diesel.
User has the meaning given to it in clause 7.
Z Crew Offer means our suite benefits, offers and services for business customers,
made available under these Terms.
Commencement
2. These Terms are a contract between you and us.
3. These Terms will commence on the first use of the Z Crew Offer by you or a User.
Eligibility
4. The Z Crew Offer is open to any Employee.
5. The immediate family of an Employee is not eligible to receive this Z Crew Offer. For the
purpose of this clause, “immediate family” means the husband, wife, spouse, parent,
siblings, or children (including stepparents, siblings and children) of the Employee.
6. To be eligible for participation in the Z Crew Offer:
(a) you must successfully complete the Z Crew Offer registration process as per our
instructions which we will notify you of in writing;
(b) any Employee that would like to participate in the Z Crew Offer must supply you
with their email address and mobile number used when registering with the Z App
as well as their Staff ID (if applicable); and
(c) you must share the information provided to you by your Employees in accordance
with subclause (b) with us in order for us to load your Employees’ information into
the Z Crew Offer database and enable access.
7. Once we have enabled access to the Z Crew Offer for an Employee, that Employee
will become a “User”.
8. If a User has not already accepted these Terms through your registration process, the
first use by a User of a Benefit confirms the User’s acceptance of these Terms.
9. You acknowledge that:
(d) each User acts as your agent in using the Z Crew Offer;
(e) you are responsible for ensuring that each User is aware of their obligations as your
agent under these Terms and the acknowledgements given by you on their behalf
in respect of our Z Privacy Policy.
Benefits under the Z Crew Offer
10. From the commencement of these Terms, a User will be entitled to:
(a) four times per calendar month, a discount of 10 cents per litre (including GST) off
the pump price of Fuel purchased at any Z service station in New Zealand when
the User uses their Z App (Fuel Discount); and
(b) once a calendar month, a discount on each of the following retail products (Retail
Product Discount):
1. 50% discount on all carwashes.
2. 100% discount on a barista made drink from the Z Espress range (excluding
frappes and smoothies).
3. 100% discount on a pie from the Z Espress Classic Pies range.
(together, the Benefits).
11. The Benefits in clause 10 are applied by the User scanning the QR code of the relevant
voucher that has been loaded onto the Z App for this purpose.
12. For the Fuel Discount, there will be up to 4 vouchers loaded onto the Z App each
month.
13. For the Retail Product Discount, there will be one voucher per product loaded onto
the Z App each month.
Limitations and exclusions
14. The Z Crew Offer does not apply to purchases made using a Z Business card.
15. The Z Crew Offer does not apply to Fuel purchases from truckstops.
16. The Z Crew Offer Fuel Discount cannot be used in conjunction or combination with
any other Fuel discount, including any Z Business fuel discount.
17. The Fuel Discount is only applicable once per Fuel transaction.
18. The Fuel Discount is only applicable once per Fuel transaction.
19. Only one Fuel Discount voucher is applicable per Fuel transaction.
Use of the Z App
20. You acknowledge that:
(a) the Benefits are available only via the Z App;
(b) in order for you or any Users to commence using the Z App, you must first
accept:
1. the Z App terms and conditions which are available on our website at
https://www.z.co.nz/products-and-services/z-app/z-app-terms-and
conditions (Z App Terms); and
2. The Z Rewards terms and conditions which are available on our website at
Terms and conditions – Z Energy, Z is for New Zealand (Z Rewards Terms);
and
(c) redemption of Benefits is subject to the Z App Terms and Z Rewards Terms.
Privacy
21. You acknowledge that, when we process your registration to join the Z Crew Offer and
in the course of our subsequent business relationship, we may collect personal
information about you and your Users.
22. Any personal information collected about individuals as part of the Z Crew Offer will be
collected, stored and used in accordance with these Terms and the Z Privacy Policy
which is available on our website at z.co.nz/privacy. Please read this policy carefully.
23. Where you provide us any personal information of your Employees and/or Users, you
are responsible for ensuring that you have obtained all necessary authorisations from
those Employees and/or Users and that they are aware of the Z Privacy Policy –
particularly the fact that we may share information about their use of the Z Crew Offer
with you.
Changes to these Terms
24. Z may change, delete, or supplement these Terms and/or any Benefits associated with
your use of the Z Crew Offer from time to time by giving you reasonable notice in
writing or by publishing the changes on our website (z.co.nz).
25. If you do not agree with Z's updated terms, you can terminate your use of the Z Crew
Offer any time in accordance with clause 26.
Suspension and Cancellation
26. We may suspend or cancel any of your User accounts or your right to participate in the
Z Crew Offer at any time by giving you reasonable notice.
27. You may request for us to suspend or cancel any User account or terminate your use
of Z Crew Offer at any time by giving notice to us by phoning 0800 ZENERGY (0800 936
374) or emailing zbusiness@z.co.nz.
Other terms
28. This Z Crew Offer is governed by New Zealand law and any dispute arising out of or in
connection with this Z Crew Offer will be subject to the exclusive jurisdiction of the New
Zealand courts.
29. Notwithstanding any other provision of this Z Crew Offer and to the extent permitted by
statute, Z will not in any circumstances be liable for any:
(a) breach by you, an Employee or User of these Terms; or
(b) indirect, consequential, incidental, special or exemplary damages, expenses,
losses or liabilities; or
(c) loss of profits, business interruption, loss of revenue, economic loss, loss of
goodwill, loss of opportunity or expectation loss or loss of production,
which may be suffered or incurred by any person (including an Employee or User) in
connection with this Z Crew Offer.
30. Z may remove an Employee or User from the Z Crew Offer for any fraudulent use or
breach of these Terms.
31. Z’s decision in relation to all matters in respect of the Z Crew Offer is final and no
correspondence will be entered into.
