The terms and conditions that apply to this promotion are the Specific Terms and Conditions and the General Terms and Conditions (together the Terms and Conditions).

General Terms and Conditions:
1. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. In these Terms and Conditions, unless the context otherwise requires, a word in the singular includes the plural and vice versa.
3. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to (a) disqualify any entrant; or (b) modify, suspend, terminate or cancel the promotion or these Terms and Conditions. Any cancellation or modification to the promotion or these Terms and Conditions will be notified on the Z Energy website.
4. The value of the Prize(s) is accurate and based upon the recommended retail value of the Prize(s) (inclusive of GST) at the date of printing. The Promoter accepts no responsibility for any variation in the value of the Prize(s) after that date.
5. No part of any Prize is exchangeable, redeemable for cash or any other prize, or transferable, unless otherwise specified in writing by the Promoter.
6. If any Prize (or portion of any Prize) is unavailable the Promoter reserves the right to substitute the Prize (or that portion of the Prize) with a prize of equal or greater value and specification.
7. If the winner chooses not to accept their Prize, is unable to accept it, fails to claim or take the Prize within a reasonable time specified by the Promoter, or is otherwise unavailable, they forfeit the Prize. The Promoter is not obligated to substitute the Prize in such circumstances.
8. If a Prize is supplied by a third party, it will be subject to that third party’s terms and conditions. In the event of any inconsistency between those terms and these Terms and Conditions (as they relate to the Prize), the third party’s terms will apply. To the extent permitted by law, the Promoter is not responsible for any delay or failure by a third party to deliver the Prize, for any issue with the Prize itself, or for the third party’s failure to meet any of its obligations.
9. If Z App is used for entry, or to claim the Prize, the Z App terms and conditions (available here, as updated from time to time) and Z Rewards terms and conditions (available here, as updated from time to time) will apply to your use of Z App and the Prize.
10. The winner acknowledges and agrees to comply with all reasonable instructions given by employees and agents of the Promoter and other parties associated with this promotion. The winner also agrees not to engage in any conduct that may bring the Promoter into disrepute
11. No entry fee is charged by the Promoter to enter the promotion. Where entry is allowed by purchase, the cost of the product is no greater than the cost would be without the opportunity to participate in the promotion.
12.The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
13. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant. The winner may be asked to show valid proof of identity at the time of collecting their Prize. Neither the Promoter nor their agents will be responsible in any way for any disputes arising as a result of entries being submitted by persons other than the registered Z App account, phone or email owner (as applicable).
14. The Promoter reserves the right to verify the validity of the winner’s entry and disqualify any entry or refuse to award a Prize where false or misleading details have been given by an entrant or an entrant has behaved in a fraudulent, dishonest or disruptive manner, or otherwise than in accordance with these Terms and Conditions or the spirit of the promotion.
15. If: (a) an ineligible entry is drawn (e.g. because the entrant is not a New Zealand resident), or (b) the entrant has already been selected to win another prize, or (c) the entrant cancels their Z App account before the Prize Draw Date, or (d) the Promoter disqualifies the entrant in accordance with these Terms and Conditions, then the Promoter may deem that entry invalid and select a new winner on the same terms as the original prize draw. In such cases, the first entrant will not be entitled to any compensation.
16. All entries submitted in this promotion become the property of the Promoter upon receipt. The Promoter may use, reproduce, publish, or otherwise exploit any entry for promotional, marketing, or other purposes without further consent or compensation to the entrant, to the extent permitted by law.
17. Acceptance of a Prize is deemed consent for the Promoter to use the winner’s details for promotional and media purposes without compensation. Any associated copyright will vest in the Promoter. For public statements and advertisements, the Promoter may publish only the winner's name and Prize won.
18. Entrants' personal information (PI) will be collected by the Promoter directly or through the Promoter’s agents or contractors. The Promoter collects PI in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to New Zealand regulatory authorities. Entry into the promotion is conditional on providing this PI. The Promoter will use and handle PI as set out in its Privacy Policy, which can be viewed here. The privacy policy also explains how entrants may access, update or correct their PI, how to make a complaint about a breach of New Zealand privacy laws or other applicable laws, and how such complaints will be handled.
19. To the extent permitted by law, the Promoter and its agents accept no responsibility for entries that are not received, are late, lost, misdirected, or submitted incorrectly, including due to technical malfunction or human error. Incomplete or indecipherable entries will be deemed invalid.
20. The winner is responsible for any tax implications that may arise from accepting the Prize - they should seek their own independent financial advice regarding their tax obligations.
21. Except for any liability that cannot by law be excluded (including any applicable statutory guarantees), the Promoter (including its officers, employees and agents) and any participating Z stations are not liable for any personal injury, or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way from:
(a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
(b) any theft, unauthorised access or third-party interference;
(c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after receipt by the Promoter), due to any reason beyond the Promoter’s reasonable control;
(d) any variation in prize value to that stated in these Terms and Conditions;
(e) any tax liability incurred by a winner or entrant; or
(f) use or misuse of a prize.

23. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
24. The Promoter’s decision is final on all matters and no correspondence will be entered into.
25. These Terms and Conditions are governed by New Zealand law and any dispute arising out of or in connection with them will be subject to the exclusive jurisdiction of the New Zealand courts.
