Statement on Smith v Fonterra case

In response to recent media coverage on the Smith v Fonterra case, Z Energy has provided the following statement.

Z Energy (Z) provided a document to Government in 2024 summarising Z’s views on the implications of the Smith v Fonterra case and the potential role of legislation. As part of the discovery process in the Smith v Fonterra case, that 2024 document has become available to Mr Smith, and Z has confirmed that Mr Smith may refer to it publicly. We stand behind the document, which reflects Z’s perspective and is consistent with our publicly stated positions.

As New Zealand’s largest transport energy company, Z is a significant emitter, with the fuel we sell to our customers contributing to greenhouse gas emissions. It is appropriate that we have engaged with Government on industry issues that have economic and environmental issues of national significance.

Z supports the Government’s decision to progress legislation reinforcing the Climate Change Response Act as the primary mechanism for addressing climate change.

Z’s long-held view is that it is the role of Government, not the courts, to develop climate policy. Clear and consistent policy direction is critical to enabling long-term investment in the energy transition, including supporting the development of lower-carbon options for customers.
